Terms and Conditions

NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO PARTICIPATE.  Entrants and Voters must be legal residents of the 50 United States or District of Columbia (“D.C.”). Entrants and Voters must be 18 years of age or older at time of Entry or vote. 

Start and end dates:
‘Show Us Your Hearing’ Photography Competition (“Competition”) begins May 24, 2010 at 12:00:01AM Eastern Time (“ET”) and ends August 10, 2010 at 11:59:59PM ET (“Competition Period”).  During the Competition Period there are a series of events which start and end on the specified dates as noted below (All Times Are Eastern Time Zone, USA unless otherwise stated):

Entry Submission Period:
Start at 12:00:01 AM ET on May 24th, 2010
End at 11:59:59 PM ET on July 19th, 2010

Public Voting Period:
Start at 12:00:01 AM ET on July 20th, 2010
End at 11:59:59 PM ET on August 3rd, 2010

Judging Period:
Start at 12:00:01 AM ET August 4th, 2010
End at 11:59:59 PM ET August 10th, 2010

Competition Winner Announcement:
On August 16th, 2010

Participants:

  • Entrant:  An Entrant is someone 18 years of age or older as of time of Entry who wishes to submit an Entry into the ‘Show Us Your Hearing’ Photography Competition.
  • Voter: A Voter is someone 18 years of age or older as of time of vote who has cast a vote in the ‘Show Us Your Hearing’ Photography Competition.

How to participate in the competition:
Entries only accepted online.  Entries must be submitted in English.

  • Go to the website about the contest.
  • If you are not already registered on www.hear-the-world.com, you must register and create a Username and Password.
  • To complete the website registration process, please confirm receipt of the e-mail which was automatically sent to you. To do this, click on the link in the e-mail or copy it into your web browser.
  • Once your account has been confirmed, click on the Competition icon.
  • Click the “Enter the contest” button which will take you to the Entry Form.
  • Complete the Entry Form by providing the information required.
  • Upload a photograph of you, a friend, or family member in the ‘Conscious Pose of Hearing.’
  • Photo must be high res (300dpi), between 1MB - 3MB.
  • All images submitted must be the work of the individual submitting them. It is the responsibility of each entrant to ensure that any images they submit have been taken with the permission of the subject and do not infringe the copyright of any third party or any laws. Entrants must warrant that the photograph they are submitting is their own work and that they own the copyright for it.
  • Give your photograph a title.
  • In the space provided write a description of up to 100 words describing the importance of being aware of your hearing at every age. 
  • Click “Send.”
  • Your Entry will not be officially entered into the Competition unless you click the final Send button and receive a confirmation screen that states that your Entry was accepted.
  • Each Entry must be the Entrant’s own original creation, executed solely by the Entrant, may not have been submitted in any other competition, and must be an unpublished and un-produced work.  Entries become the property of the Sponsor and will not be acknowledged or returned.  Personal information collected from Entrant will be used solely for the purposes of the Competition and to notify the finalists-winners, and will not be re-used, sold or shared in any manner by Sponsor or any third parties unless you otherwise agree in accordance with Sponsor’s privacy policy.
  • Limit of one Entry may be submitted per Entrant per Competition Period.

How to participate in the sweepstakes:

  • Go to the website about the contest.

  • Once your account has been confirmed click on the Competition icon.
  • Click the Gallery button which will take you to the ‘Show Us Your Hearing’ Entries.
  • Limit of one vote per ‘Show Us Your Hearing’ entry per day per Voter.
  • One vote is the equivalent of one Sweepstakes entry.

Promotion Entities:
The Promotion is sponsored by Hear the World, Laubisrütistr. 28 CH-8712 Stäfa Switzerland, (“Sponsor”) and administered by Marden-Kane, Inc., 1055 Franklin Ave. Garden City, NY 11530, U.S.A. (the “Administrator”) (collectively referred to as the “Promotion Entities”).

Prohibited Content:

Each Entry must be in keeping with the Sponsor’s image and may not be obscene, indecent or otherwise offensive, as determined by judges or Sponsor in their sole discretion, nor can they defame or invade publicity rights or privacy of any person, living or deceased, or otherwise infringe upon any person’s personal or proprietary rights including but not limited to intellectual property rights. Any Entrant whose submitted material contains elements not owned by the Entrant (such as, but not limited to company or team trademarks) will be disqualified.  Submissions that are incomplete or do no comply with these terms and conditions are subject to disqualification.  Submission of an Entry, grants Sponsor the right to use, publish, adapt, assign, edit, dispose of, and/or modify such Entry and the concepts embodied therein in any way, in commerce and in any and all media worldwide, without limitation or compensation to the Entrant and may be required to sign a release to that effect. Any Entry information collected from the Competition shall be used only in a manner consistent with the consent given by Entrants at the time of Entry, with these Official Rules, and with Sponsor’s Privacy Policy.  Entries will not be returned and, in Sponsor’s discretion, may be destroyed.

Public Voting:
From July 13, 2010 to August 03, 2010 (Voting Period), Entries will be posted at the Gallery. Visitors will be able to vote for their favorite ‘Show Us Your Hearing’ Entry.  Limit one vote per person per day.  The top 5 Entries that received the most votes will then go on to the judging period.

Judging to determine competition winner:
The top five Entries that received the most votes during the Public Voting Period will be judged by a panel of judges from the Hear the World initiative under the supervision of Hear the World in conjunction with Marden-Kane, Inc. Entries will be scored based on the following judging criteria:

  • Most visually appealing- 50%
  • Originality- 30%
  • 100- word description- 10%
  • Self-explanatory- 10%

Based on the Panel’s scores, the top scoring Entry will become the Grand Prize Winner.

In the event of a tie in either the judging or public voting, all tied Entries will be re-judged by an additional independent judge, who, using the judging criteria, will break the tie.  The Judges’ decisions are final and binding in all matters relating to this Promotion. 

Random sweepstakes drawing:
Sweepstakes Prize winners will be selected in a random drawing, from among all eligible votes, under the supervision of Marden-Kane, Inc., an independent judging organization, whose decisions are final on all matters relating to this Competition. Odds of winning depend upon the number of eligible Entries received. 

Prizes:

  • Competition Grand Prize (1): A Polaroid 300 Instant Camera. Approximate Retail Value (”ARV”) $89.99
  • Sweepstakes Prize Winners (3): An iTunes Gift Card. ARV $50.00 each. 

Total value of all prizes $239.99. Taxes, if any, are the responsibility of the winners.  No substitution or transfer of any prize permitted, except that Sponsor may in its discretion substitute a prize of equal or greater value.  iTunes Gift Cards are subject to terms and conditions printed thereon Limit one prize per household.

Winner notification:

The potential Competition and Sweepstakes Prize Winners (“Potential Winners”) will be notified via courier, telephone and/or email on or within five (5) days following the dates listed on the chart above and may be required to sign and properly complete the following documents and return them via email or fax/facsimile (and subsequently send the completed documents by mail per instructions to be provided) to Administrator (Marden-Kane, Inc.) within five (5) days of date on notification: (1) an Affidavit of Eligibility and Publicity Release, unless prohibited by law;  (2) such other and further agreements as may be required by the Sponsor with regard to right transfers and releases.  If any documents sent by any means to a Potential Winner is returned as undeliverable or if a Potential Winner fails to properly execute and return all documents described herein within the time period noted, or if a Potential Winner is found not to be eligible or not in compliance with these Official Rules, the potential prize winner will be disqualified and, at the sole discretion of the Sponsor, and the next highest scoring Entry will move up and the Entrant who submitted such eligible Entry will be notified, time permitting.  In addition, each Entrant acknowledges and agrees that the Promotion Entities reserve the right to disqualify any potential prize winner at any time, in its sole discretion, on the basis of anything contained in or learned or obtained as a result of any submitted Affidavits and agreements required by Sponsor.

Ownership and use of entries:
Copyright for all images submitted for this competition remains with the respective Entrants. However, in consideration of their providing the Entry to the Competition, each Entrant grants a worldwide, irrevocable, perpetual license to the Hear the World initiative to feature any or all of the submitted images in their publications, on their websites and/or in any promotional material connected to this competition.

Limitation of Liability:
Except and to the extent that the negative consequences described below are the foreseeable result of matters within the Competition Entities' reasonable control and are the direct consequence of gross negligence or default by any of them, neither control the Competition Entities nor any of their respective parents, subsidiaries, affiliates, application developers, advertising and promotion agencies, legal and financial advisors, any and all other companies associated with this Competition or any of their respective officers, directors, shareholders, agents, licensees, licensors and employees, nor any Internet access providers (collectively, “Released Parties”) are responsible for any incorrect or inaccurate Entry of information, human error, technical malfunction, lost/delayed data transmission, omission, interruption, deletion, defect, line failure of any telephone, computer or other network, computer equipment, software or any combination thereof, inability to access the Hear the World website(s), or for late, lost, damaged, misdirected, delayed, garbled, incorrect or incomplete Entries. 

EACH ENTRANT ACCEPTS THE CONDITIONS STATED IN THESE OFFICIAL TERMS AND CONDITIONS, AGREES TO BE BOUND BY THE DECISIONS OF THE COMPETITION ENTITIES AND WARRANTS THAT S/HE IS ELIGIBLE TO PARTICIPATE IN THIS COMPETITION, AND AGREES EXCEPT TO THE EXTENT THAT ANY PERSONAL INJURY OR DEATH IS CAUSED BY THE RELEASED PARTIES' NEGLIGENCE OR BREACH OF THESE OFFICIAL TERMS AND CONDITIONS THAT THE RELEASED PARTIES SHALL NOT BE RESPONSIBLE FOR ANY CLAIMS, LOSSES, LIABILITY, AND DAMAGES OF ANY KIND (INCLUDING REASONABLE ATTORNEYS’ FEES AND EXPENSES), ASSERTED AGAINST ANY OF THEM, INCURRED, SUSTAINED, OR ARISING IN CONNECTION WITH THE USE, ACCEPTANCE, OR MISUSE OF ANY ENTRY MATERIAL, OR WHILE PREPARING FOR, PARTICIPATING IN, AND/OR TRAVELLING TO OR FROM ANY PROMOTION-RELATED ACTIVITY, INCLUDING, WITHOUT LIMITATION, ANY INJURY, DAMAGE, DEATH, LOSS, OR ACCIDENT TO PERSON OR PROPERTY, OR FROM THE RESPECTIVE ENTRANT'S BREACH OF ANY AGREEMENT OR WARRANTY ASSOCIATED WITH THE PROMOTION, INCLUDING THESE OFFICIAL TERMS. ANY ATTEMPT TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE PROMOTION IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND, SHOULD SUCH AN ATTEMPT BE MADE, THE PROMOTION ENTITIES AND EACH OF THEIR LICENSEES RESERVE THE RIGHT TO SEEK DAMAGES OR OTHER REMEDIES FROM ANY SUCH PERSON(S) RESPONSIBLE FOR ANY SUCH ATTEMPT TO THE FULLEST EXTENT PERMITTED BY LAW.

Winners:
Winners will be posted on the Hear the World website.  Winners will remain up on the Hear the World website for 30 days from date posted.
